Fixed Fee Eviction Services:

1)     Initial Consultation: £150.00 plus VAT. This includes:

  • Considering the tenancy agreement (including checking whether or not you can claim legal costs from your tenant).
  • Checking that any tenancy deposit taken by you or your agent has been correctly protected.
  • Considering whether the tenant has breached any of the provisions of the tenancy agreement (including any failure to pay rent on time, or at all).

2)     Draft a Section 8 Notice: £150.00 plus VAT. This includes:

  • Drafting a Section 8 of the Housing Act 1988 (as amended) Notice seeking possession and a letter to your tenant explaining what the Notice means.
  • Advising you what may be the best way to serve the Notice.
  • Drafting a Certificate of Service confirming service of the Notice.
  • Advising you how to safely check the property to consider if your tenant has vacated (“surrender of the tenancy”).

3)     Draft a Section 21 Notice: £70.00 plus VAT. This includes:

  • Drafting a Section 21 Notice of the Housing Act 1988 (as amended) seeking possession and a letter to your tenant explaining what the Notice means.
  • Advising you what may be the best way to serve the Notice.
  • Drafting a Certificate of Service confirming service of the Notice. 
  • Advising you how to safely check the property to consider if your tenant has vacated (“surrender of the tenancy”).

4)     Issuing Court proceedings (if the tenant has not vacated):  £180.00 plus VAT. This includes:

  • Drafting the Claim Form, Particulars of Claim and a Schedule of Payments.
  • Advising you regarding your liability for legal costs.
  • Filing the paperwork at Court and letting you know that we have done so (including informing you when a Possession Hearing is likely to be scheduled).

5)     Possession Hearing preparation: £370.00 plus VAT. This includes:

  • Considering the Notice of Issue and the Notice of Hearing and informing you when the Possession Hearing will take place.
  • Considering your tenant’s Defence and advising you on your prospects of success regarding continuing with the claim.
  • Drafting your Witness Statement (maximum of one) and including the exhibits you want to rely on at the Hearing (maximum of 10).
  • Filing your Witness Statements and exhibits with the Court and serving a copy on your tenant.
  • If applicable, drafting a Statement of Costs (setting out the amount of legal costs you want to claim from your tenant), filing it at Court and serving a copy on your tenant.
  • Considering your tenant’s Statement of Costs and Witness Statement (maximum of one) and advising you on your prospects of success if you continue with your claim. 
  • Preparing for the Possession Hearing.

6)     Attendance at the Possession Hearing: £250.00 plus VAT. This includes:

  • Attending the Hearing (including any waiting time and travel time). If you want to be present, this fixed fee will include time spent speaking to you immediately before the Hearing begins and immediately after it ends.
  • Making submissions at the Hearing on your behalf.
  • Contacting you to inform you what happened at the Hearing and to provide you with this information in writing.
  • Considering the typed Court Order sent by the Court after the Hearing has taken place.

Disclaimer:

-        Our fixed fee does not include dealing with any work in respect of a Counterclaim being made by the tenant, instructing a barrister, attending more than one Hearing, appealing a decision made by the Court or enforcing any Order made by the Court.

-        The fee set out for attending the Court is based on a Hearing taking place at the County Court at Preston or Lancaster. There may be an additional charge if the Hearing takes place elsewhere, depending on the location.

-        Our fixed fee does not include the Court fee payable to issue proceedings.
